Once the project fee is paid in full to Multicultivate Experience Design Solutions, LLC., any elements of text, graphics, photos, contents, trademarks, or other artwork furnished to Client for inclusion in marketing or website materials are owned by the Client.

Multicultivate Experience Design Solutions, LLC. assumes the Client has permission from the rightful owner to use any graphics, photos, contents, trademarks, or other data provided by the Client for inclusion in its’ materials, and will hold harmless, protect, and defend Multicultivate Experience Design Solutions, LLC. from any claim or suit arising from the use of such work. Multicultivate Experience Design Solutions, LLC. retains the right to display graphics and other design elements as examples of their work in their portfolio and as content features in other projects.

Regardless of the place of signing the agreement, the Client agrees that for the purposes of venue, services & contract was entered into in GEORGIA and any dispute will be litigated or arbitrated in GEORGIA.

The agreement contained in this contract constitutes the sole agreement between the Client and Multicultivate Experience Design Solutions, LLC. regarding all items included in signed agreements.

SCOPE OF POLICY

Please be aware that requests outside the stated terms of the original agreements are subject to additional charges. This includes, not limited to, the following:

--Requests for additional consultation / strategy calls (30 minutes or more).
‍
--Requests for additional features, functionality or written content on websites/landing pages and/or other brand marketing materials.

--Requests for additional revisions outside the stated agreed upon number (typically, this is more than 3 revisions).

--Requests for work outside of the original agreement.

Clients agree that they are hiring Multicultivate Experience Design Solutions, LLC. as an Independent Agency to provide the agreed upon services. As such, the following statements reflect this relationship:

--Multicultivate Experience Design Solutions, LLC. will use their own equipment, tools, and material to complete the work.

--The Client will not control how the job is performed on a day-to-day basis. Rather, Multicultivate Experience Design Solutions, LLC., is responsible for determining when, where, and how they will carry out the work.
‍
--The Client will not be required to provide us with any training.
‍
--We do not have a partnership or employer-employee relationship.
‍
--Multicultivate Experience Design Solutions, LLC. cannot enter into contracts, make promises, or act on behalf of the Client.
‍
--Multicultivate Experience Design Solutions, LLC. is not entitled to benefits provided by the Client's business, i.e. group insurance, retirement benefits, vacation days, etc.
‍
--Multicultivate Experience Design Solutions, LLC. will maintain the confidentiality of any information that the Clients furnishes to us for the completion of the project(s).
‍
--Multicultivate Experience Design Solutions, LLC. is responsible for their own taxes.

--The Client will not withhold social security and Medicare taxes or make payments for disability insurance, unemployment insurance, or workers compensation for Multicultivate Experience Design Solutions, LLC. or any of our employees / subcontractors.
